These terms and conditions (“Terms”) govern your use of the Gradhaven website (gradhaven.co.za) and your application for accommodation at Gradhaven Montana, 249 Voortrekker Road, Parow, Cape Town. By using this website or submitting an application, you agree to these Terms.

1. Website use

This website is provided for informational purposes and to facilitate accommodation applications. Content on this site is subject to change without notice. While we strive to keep information accurate, we do not guarantee that all details (including pricing and availability) are current at all times.

2. Applications

Submitting an application via this website does not guarantee a room allocation. All applications are subject to availability and review by the Gradhaven team. A confirmed placement requires a signed lease agreement and any applicable deposit or first month's payment.

3. Pricing

All prices displayed on this website are in South African Rand (ZAR) and are per person, per month. Inclusions and exclusions are communicated in current room details and lease documentation. Gradhaven reserves the right to adjust pricing for future academic periods.

4. Lease agreement

Accommodation at Gradhaven Montana is governed by a separate lease agreement between the resident and Gradhaven. The lease agreement, not these website Terms, governs the rights and obligations of both parties during the tenancy. The lease complies with the Rental Housing Act of South Africa.

5. Funding-supported students

Students whose accommodation is funded by NSFAS or other bursary providers are subject to the terms and disbursement schedules of their respective funding bodies. Funding documentation and process requirements may change and are confirmed during placement.

6. Intellectual property

All content on this website — including text, images, logos, and design — is the property of Gradhaven and may not be reproduced, distributed, or used without prior written consent.

7. Limitation of liability

Gradhaven is not liable for any indirect, incidental, or consequential damages arising from the use of this website, including but not limited to errors in content, service interruptions, or third-party actions.

8. Governing law

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of the Western Cape.
